Terms and Conditions
Last updated: October 2, 2026
These Terms and Conditions ("Terms") form a binding agreement between you and MySweaty, LLC, a Texas limited liability company ("MySweaty," "we," "us," or "our"), governing your use of the MySweaty app, the mysweaty.com website, and everything they connect to (together, the "Service").
By creating an account, checking the box that says you agree, or otherwise using the Service, you accept these Terms and our Privacy Policy, which is part of this agreement. If you do not agree, do not use the Service.
Two sections deserve your attention before the rest: Section 8, because meeting strangers to exercise carries real risk and you take that risk on yourself, and Section 16, because it sends most disputes to individual arbitration and limits class actions.
1. Agreement to these Terms
The box above is the agreement in short. These Terms apply to every part of the Service, on every device, whether you signed up with an email address, with Apple, or with Google. Where these Terms and the Privacy Policy both speak to the same thing, the Privacy Policy governs how your data is handled and these Terms govern everything else.
2. Eligibility — you must be 18 or older
MySweaty is for adults. You must be at least 18 years old to create an account or use the Service. There is no parental-consent path and no account tier for minors.
By creating an account you represent that:
- •You are at least 18 years old;
- •The date of birth you give us is your real one;
- •You can enter into a binding contract;
- •You have not previously been removed from the Service; and
- •You are not barred from using it under the laws where you live.
2.1 How we check age — and what that check is worth
We ask for your date of birth during signup, on every route into the Service — email and password, Sign in with Apple, and Sign in with Google. If the date you enter puts you under 18, the signup is refused and no account is created.
We would rather be precise than reassuring about what that does and does not mean:
What we do
Collect a date of birth at signup and refuse anyone under 18. Store that date, encrypted, plus the time you accepted these Terms and the version you accepted. Rate the app 18+ on the App Store, so Apple's parental controls can block the download.
What we do not do
Check that date against a government ID, a credit file, or any third-party age-verification service. We do not use Apple's Declared Age Range API. Someone who types a false date of birth can get past this check.
You agree not to circumvent, disable, falsify, or interfere with any age check, and not to let anyone under 18 use your account. Entering a false date of birth breaches these Terms and is grounds for immediate termination.
2.2 Accounts belonging to minors
If we learn or reasonably believe an account holder is under 18, we suspend the account at once, without notice, and then terminate it and delete the associated data as described in our Privacy Policy. If you believe someone under 18 is using the Service, report the account in the app or write to contact@mysweaty.com.
3. Your account
Registration. Give us accurate information and keep it current. One account per person. Accounts are personal to you and may not be sold, transferred, or shared.
Security. You are responsible for your credentials and for everything done under your account. Signing in with your email and password on a device we have not seen before requires a code emailed to you; devices you have already verified are remembered for 90 days. Signing in with Apple or Google relies on their verification instead, and no code is sent. Tell us at contact@mysweaty.com immediately if you think someone else is using your account.
Sign-in providers. If you sign in with Apple or Google, your use of those services is governed by their terms, and you authorize us to receive the account information they hand over.
Sessions. Signing in may end other active sessions on your account.
4. License to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the MySweaty app on an Apple-branded device you own or control, and to use the Service, for your personal, non-commercial use.
You may not copy, modify, or make derivative works of the Service; reverse engineer, decompile, or disassemble it except where that restriction is prohibited by law; rent, lease, sell, or sublicense it; remove proprietary notices; use automated means to access, scrape, or collect data from it; or try to gain unauthorized access to any part of it. All rights not expressly granted are reserved.
5. Acceptable use, reporting, and enforcement
MySweaty exists so adults can find people to train with. Almost everything that serves that purpose is fine. This section is about the conduct that does not.
You agree not to use the Service to:
- •Harass, threaten, stalk, intimidate, defame, or abuse anyone;
- •Post or send content that is unlawful, hateful, sexually explicit, violent, or that promotes discrimination against a protected group;
- •Solicit, groom, or attempt to contact anyone you know or suspect to be under 18;
- •Impersonate anyone, or misrepresent your identity, age, or affiliation;
- •Post sexual content, solicit commercial sexual services, or use the Service primarily to pursue romantic or sexual encounters rather than physical activity;
- •Send unsolicited commercial messages, run multi-level-marketing or recruitment schemes, or use messages and join requests as an advertising channel;
- •Distribute spam, chain messages, malware, or bulk unsolicited communications;
- •Post links to malware, phishing pages, or sites that violate these Terms;
- •Use automated means to collect, scrape, or store other users' information, including photos, location, or contact details;
- •Share another user's private information, or a group's non-public meeting location, outside the Service without permission;
- •Interfere with, overload, or disrupt the Service, its servers, or its security;
- •Break any law or any third party's rights.
Organizing is not advertising
Running a club, a class, a training group, or a recurring session — including one you are paid for elsewhere — is a normal use of MySweaty. So is linking to your own gym, club, race, or training profile in your bio, your group description, or a conversation. What this section prohibits is pushing goods and services at people who did not ask.
5.1 Reporting and blocking
Every user profile, every group, and every conversation has a Report control. Reporting takes a few seconds, does not notify the person you reported, and covers objectionable content, harassment, impersonation, an account you believe belongs to someone under 18, or anything else unsafe.
You can also Block any user, from their profile or from the same menu. Blocking is immediate and works both ways: neither of you can message or find the other, including inside groups you share, your conversation closes and leaves your inbox, and you can undo it from Blocked Users. Blocking does not require a report, reporting does not require a block, and the report screen offers to do both at once.
A group's owner or admin can also use Block and Remove in the group's member list. It removes that person from the group and blocks them in one step, and the block is the same as any other: it works both ways, and any 1:1 conversation the two of you had closes and leaves your inbox.
5.2 What we do with reports
We review every report. We act on reports of objectionable content or abusive users within 24 hours of receiving them.
Acting means one of: suspending the account, removing the content, terminating the account, or — where we conclude no violation occurred — closing the report.
Here is exactly what each of those is, so nothing is left to guesswork:
- •Suspending signs the account out everywhere at once and stops it from signing in again. The person is shown that the account is suspended, and why. Suspension stops the account from being used; it does not, on its own, take the account's profile or past content out of view.
- •Removing content means a person on our team deletes the photo, message, group, or profile text in question.
- •Terminating means a person on our team deletes the account, which removes it and its content as described in the Privacy Policy.
- •Closing means we reviewed the report and found nothing that breaks these Terms.
Every one of these is done by a person, not by software. There is no automatic filter deciding what stays up, and nothing is removed without someone on our team having looked at it. Once a report has been reviewed, we email the person who filed it. To protect the person reported, that email says whether we acted, not what we did.
We may also, at our discretion and without notice, remove or restrict any content, limit or disable features on an account, suspend or terminate an account, and preserve or disclose information where we believe in good faith that the law requires it or that it is necessary to prevent imminent harm.
Filing reports you know to be false, in volume, or to harass someone is itself a violation of these Terms.
In an emergency, contact local emergency services first. We are not an emergency service and cannot intervene in a situation as it happens.
6. Your content
"Your content" means anything you put into the Service. Today that is exactly this:
| What | Where it appears |
|---|---|
| Up to six profile photos | Your profile, and cards in other people's feeds |
| Name, username, bio, city, and up to two sports | Your profile and Explore |
| Groups you create — name, description, photos, sport, city, weekly schedule, meeting location | The group page; the schedule and the meeting location only where the owner allows it |
| Events and workout invites — title, description, date, location, photo | The group chat, or the conversation you sent the invite in |
| Messages | The conversation you sent them in |
You own it. Putting something into MySweaty does not transfer ownership of it to us.
The license you give us, in full
You grant MySweaty a worldwide, non-exclusive, royalty-free license to host, store, back up, resize and re-encode, and display your content, solely so the Service can show it to the people it is meant for. That is the whole of it. We do not use your photos, name, or content in advertising or marketing, and we do not sell or license your content to anyone else.
The license ends when you delete the content or your account, with these exceptions: messages you posted in a group, which stay with that group until your account is erased; a group you created that other people are still in, which keeps the name, description, photos, schedule, and meeting place you gave it; a copy attached to an abuse report, which is kept with the report; and copies in routine backups, for a commercially reasonable period. The Privacy Policy sets out each of these in full.
What you promise. That you own or have the rights to what you post, and that it infringes nobody's rights and breaks no law.
Photos of other people. Do not upload photos of other people without their permission. Do not upload photos of anyone under 18.
Moderation. We may review, remove, or restrict content at any time, with or without notice, and we act on reports as described in Section 5.2. Beyond that we do not pre-screen content, we are not responsible for what users post, and we do not endorse it.
Copyright complaints. If you believe content on the Service infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to contact@mysweaty.com. Include the work you say is infringed, where it appears on the Service, your contact details, and the statements that section requires. We remove infringing content and terminate repeat infringers.
7. Groups, events, and organizers
Groups. Anyone can create a group built around a sport or activity, and anyone can ask to join one. Owners and admins approve or deny join requests and remove or block members. Only the owner appoints or removes admins, up to seven per group, and an admin cannot remove the owner or another admin. Owners are responsible for how their group behaves and for the accuracy of what they post, including the meeting location.
When an owner steps away. An owner can make any member the new owner at any time, and then stays in the group as a member. An owner can also delete the group, or simply leave it. When an owner leaves without choosing a successor, or deletes their account, the admin who has been in the group longest becomes the owner. If the group has no admin, it closes: it has no owner, takes no new members, leaves Explore and My Groups, and its chat becomes read-only, with the people in it keeping its history in their Archived Chats. Once the last of them leaves, it is deleted within a month. If nobody else is in it, it is deleted right away. When an owner deletes their account, this happens when the account is erased, 45 days later.
Public and private groups. A public group is listed on Explore. A private group is not: it does not appear on Explore or on its members' profiles, and people find it through a link a member shares. Until they are approved, they see only its name, sport, first photo, and owner.
Events. Group owners post events into the group chat, and connected users send each other workout invites. These are organized by users, not by us. MySweaty is not the organizer, host, sponsor, or operator of any event on the Service, and is not responsible for whether it happens, how it is run, or what occurs at it.
If you organize. You are solely responsible for laws, permits, venue rules, insurance, and participant safety, and you indemnify us for claims arising from events you organize, as set out in Section 15.
8. Meeting in person — you assume the risk
This is the most important section of these Terms.
MySweaty is built to help adults meet in person to exercise. Meeting strangers and training carry real risks — serious injury, illness, permanent disability, death, and also theft, assault, harassment, and other criminal conduct.
You acknowledge and agree that:
1. We do not verify who anyone is
We do not screen, vet, verify the identity of, or run criminal background checks on any user, group, or organizer. The only age check we perform is the self-reported date of birth in Section 2.1, which we do not verify against any document or service. We make no representation about any user's identity, age, character, fitness, qualifications, or intentions.
2. We are not there
We do not supervise, control, or take part in any meetup, workout, event, or interaction between users, whether it was arranged through the Service or not.
3. You assume all risk
You choose, voluntarily, to talk to and meet other users, and you take full responsibility for every risk that comes with it — including risk created by another user's negligence.
4. Your safety is yours to manage
Meet in public. Tell someone where you are going. End anything that feels wrong. Use judgment you would use meeting any stranger.
The tools you have
You can Block any user and Report any user, group, or conversation from inside the app, at any time, without explanation and without notifying them. Group owners can set a meeting location to members-only. Use them — Section 5.1 explains how, and Section 5.2 explains what happens next.
Release
To the fullest extent permitted by law, you release and forever discharge MySweaty, LLC and its members, officers, employees, and agents from any and all claims, demands, damages, and causes of action arising out of or relating to your interactions with other users, your participation in any activity or event, or any injury, loss, or harm you suffer in connection with the Service.
Report unsafe conduct or harassment through the in-app Report control, or at contact@mysweaty.com. In an emergency, contact local emergency services first.
9. Health and physical activity
MySweaty is not a medical, healthcare, or fitness-instruction provider. Nothing on the Service is medical advice, and nothing here substitutes for a qualified healthcare professional.
Talk to a physician before starting any exercise program. Deciding whether an activity suits your physical condition is yours alone, as is training within your limits and stopping when you feel pain, dizziness, or distress. You take part in all physical activity at your own risk.
10. Fees — the Service is free
MySweaty is free. No purchase price, no subscription, no in-app purchases, no paid tier.
Nothing in the app charges you, and we do not collect or store card details, bank details, or any other financial information.
We do not process payments between users. If an organizer charges for something arranged through MySweaty — a class, a race entry, a court booking — that happens entirely outside the Service, between you and them. We are not a party to it, take no fee from it, and have no role in refunds, chargebacks, or disputes about it.
If we ever add paid features, we will publish terms covering pricing, refunds, and processing before you can be charged anything, and notify you as described in Section 17.
11. Privacy and location
What we collect and what we do with it is set out in full in our Privacy Policy, which forms part of these Terms. The summary below does not replace reading it.
Location. The app never reads your device's location. It holds no location permission and no GPS access. When you set your city, we store the coordinates of that city's center from a reference table — the same coordinates for everyone in that city — and use them to find the people and public groups within the search radius you pick, from 1 to 100 miles. Location is optional and you can remove it at any time, but Explore needs one: without a location it shows you no one and does not show you to anyone. The rest of the app works without it.
Group meeting locations. A group's meeting location is typed in by its owner, who chooses whether it shows publicly or only to members, and it is stored encrypted. Do not publish a precise location — yours or anyone else's — that you would not want a stranger to have.
Photos. Every photo is rebuilt from its pixels on our server before it is stored, whether it came from the app or the website. No metadata is kept: no EXIF, no GPS coordinates, no timestamps, no camera details. They live on a private disk and are served only to signed-in users — no public URL, nothing for a search engine to index.
Messages. Messages are stored so conversations survive across devices. They are not end-to-end encrypted. Treat a message as something we are technically able to read, and do not send what you would not want stored on a server. In practice we read message text in one situation only: when a conversation or a message is reported, a copy of what was reported is reviewed by a person (see Section 5.2).
Deletion. You can delete your account yourself, at any time: open your own profile, open the menu in the top corner, and choose Delete Account. The website offers the same control and asks for your password; an account created through Apple or Google has no password and is deleted in the app, by confirming a code we email you. The Privacy Policy sets out exactly what deletion removes and what persists — including abuse reports, and groups you owned that still have other members.
12. Apple App Store terms
These Terms are between you and MySweaty, LLC only, not with Apple Inc. ("Apple"). You acknowledge and agree that:
- 1.Apple has no obligation to provide maintenance or support for the app.
- 2.If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- 3.Apple is not responsible for addressing any claim by you or a third party relating to the app or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
- 4.If a third party claims the app infringes its intellectual property, MySweaty, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
- 5.You are not in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and you are not on any U.S. Government list of prohibited or restricted parties.
- 6.Apple and its subsidiaries are third-party beneficiaries of these Terms and, on your acceptance, may enforce them against you.
Your use of the app must also comply with the Apple Media Services Terms and Conditions.
13. Termination
By you. Stop using the Service and delete your account whenever you like. Open your own profile, open the menu in the top corner, and choose Delete Account — in the app, or on the website if your account has a password.
By us. We may suspend or terminate your access at any time, with or without notice, including where we believe you have broken these Terms, are under 18, gave a false date of birth, or pose a risk to other users or to MySweaty.
Effect. Your license ends immediately. Sections 6 (for content already shared), 8, 9, 14, 15, 16, and 17 survive.
14. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, MySweaty disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content or user information — including any user's stated age or identity — is accurate, complete, or reliable. We make no warranty about the conduct of any user, online or offline.
Some jurisdictions do not allow certain warranties to be excluded, so parts of this may not apply to you.
15. Limitation of liability and indemnification
To the fullest extent permitted by law, MySweaty, LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business interruption, arising out of or relating to these Terms or the Service, whether in contract, tort, strict liability, or any other theory, even if advised of the possibility.
The Service is provided free of charge. Our total aggregate liability for all claims arising out of or relating to these Terms or the Service will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow liability for personal injury or certain damages to be limited, so parts of this may not apply to you.
Indemnification. You agree to indemnify, defend, and hold harmless MySweaty, LLC and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Service; (b) your content; (c) your violation of these Terms or of any law or third-party right; (d) your interactions with other users, online or in person; and (e) any event you organize or attend.
16. Dispute resolution
Talk to us first. Before filing any claim, email contact@mysweaty.com with a written description of the dispute, and give us at least 60 days to resolve it informally.
Arbitration. If that does not resolve it, you and MySweaty agree that any dispute arising out of or relating to these Terms or the Service will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration takes place in Harris County, Texas, or by videoconference if you prefer. Judgment on the award may be entered in any court of competent jurisdiction.
Exceptions. Either of us may bring an individual claim in small claims court, and either of us may go to court for injunctive relief to protect intellectual property.
Class action waiver. You and MySweaty agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Opting out. You may opt out of this arbitration agreement by emailing contact@mysweaty.com with the subject line "Arbitration Opt-Out," from the address on your account, within 30 days of first accepting these Terms. Opting out changes nothing else in these Terms.
Governing law. Texas law governs these Terms, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in Harris County, Texas.
17. General
Changes to these Terms. We may change them. If a change is material, we will tell you in the app or by email at least 30 days before it takes effect, and move the date at the top of this page. Using the Service after the effective date means you accept the new version. If you do not, stop using the Service and delete your account.
Changes to the Service. We may add, change, or remove features at any time.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and MySweaty about the Service, and replace anything that came before.
Severability. If a provision is unenforceable, it is limited or cut to the minimum extent necessary and the rest stands.
No waiver. Not enforcing something once does not mean we gave up the right to enforce it later.
Assignment. You may not assign these Terms. We may, in a merger, acquisition, or sale of assets.
Force majeure. We are not liable for failures or delays caused by things outside our reasonable control.
18. Contact
One address, monitored for all of it — support, safety and abuse, privacy and data requests, copyright notices, and legal notices. Reports sent from inside the app land in the same place and are the fastest route for anything urgent.
Postal address
Legal notices and service of process may be sent to our registered agent:
MySweaty, LLC
c/o Republic Registered Agent LLC
17350 State Hwy 249, Ste 220
Houston, TX 77064
United States
That address is for formal legal notices. For anything else — support, safety, privacy requests, copyright — email reaches us faster and is the route we actually monitor.
Looking for what we collect and why? That is the Privacy Policy.
